Will of Ezekiel Andrew Downing

I, Ezekiel Andrew DOWNING, of the County of Lincoln and State of Missouri,
being of sound mind and disposing memory, do make and declare the following
to be my last Will and Testament, hereby revoking all former Wills by me
made.
1st. I desire so soon after my death as possible that all of just debts be
paid, including my burial expenses. Also that a grave stone be placed to my
grave like the one I placed at the grave of my beloved wife Mildred.
2nd. I desire that of my estate $100.00 be expended in fencing and caring
for the cemetary on the land of D. C. DOWNING, known as the Downing
Cemetary.
3rd. At my death I desire that the sum of $5.00 be given by the Executor of
this my will to my sister Elizabeth M. BLAIR and heirs. To my sister Sarah
M. BLAIR and heirs $5.00, to Brother John H. DOWNING and heirs $5.00, to
sister Rachel COBB and heirs $5.00, to Sister Mary ... ELSBERRY and heirs
$5.00, to Brother D. C. DOWNING $5.00, to my sister Annie MOUNCE and hiers
$5.00, my two sisters Nancy FARMER and Elzinia DOWNING and Brother W. M.
DOWNING having died without heirs. Also in consideration of the affection
and the many kindnesses and services rendered to me, I bequeath to Louie B.
DOWNING and Vecie L. DOWNING at my death the west part of the Northwest
quarter of section 5, and part of N.E. 1/4 of sec. 6, Township 50, Range 1
East, to contain 31 80/100 acres. Also the south part of the Northwest
quarter and the north part of the S. West quarter of section six, Township
50, Range 1 East, containing Seventy-Two acres.
Also to Mrs Stella LONSBERRY and Ellen DOWNING ... the Home Place so long
as they occupy the place together, but in case of a division then Mrs Stella
LONSBERRY and Ellen DOWNING are to equally divide the household and kitchen
furniture, and Ellen DOWNING, ..., is to have the south part of the East
half of the Northwest quarter of section six, containing 50 acres, and Mrs.
Stella LONSBERRY is to have the South half of the Northwest of the
Northeast, and the north part of the east half of the Northeast quarter of
section six, Township 50 Range 1 E. Also the south part of Survey 1819, 40
acres, Township 51 Range1 East.
It is my will that at my death whatsoever property I own, both real and
personal and mixed shall pass to my legatees as above named, and the title
thereof at once vest in them my said heirs, absolutely so that they own and
control and dispose of as they may please as well and fully as I could if
living. And I so will, bequeath and dispose of the same to them.
4th I hereby constitute and appoint as executor of this my last Will and
Testament Louie B. DOWNING and order that he may carry the provisions of
this will into effect without bond.
In witness whereof I, Ezekiel Andrew DOWNING have at the County of Lincoln
and State of Missouri on this the 19th day of April 1909, set my hand and
affixed my seal to this my last Will and Testament in the presence of the
witnesses whose signatures are appended below.
