Will of David C. Downing (written 6 Aug 1909)

I David C. DOWNING of the county of Lincoln and the State of Missouri on this 6th day
of August A.D. 1909 being more than of Twenty One years of age, and of sound mind, do make
and execute the following as and for my Last Will and Testament hereby revoking any former
wills hertofore by me made.
1st. It is my will that my executors hereinafter appointed pay any and all debts by me
owing at the time of my death including my burial expenses, and erect such grave stones to
my memory as they shall select to be paid from any property that may come into their hands
as executors of my estate. And after the payment of the above amounts, then it is my will
and I dispose of direct and bequeath, that all the remainder of my property of any and all
kinds and charachter and where situate, that I shall die possesed of or belong to me at
the time of my death be divided as follows.
To my beloved wife Drucilla F. give devise and bequeath to be hers absolutely an undivided
one third of all the property real personal or mixed
that I may die possesed of, subject to its proportionate part of the payment of the items
mentioned in the first clause of this will, the above bequest of to be in lieu of all
dower homestead and exemption rights, which she the said Drucilla F. shall have as my
widow.
The remaining two thirds of my estate I give and bequeath in equal parts to my son Louis
B. and my daughter Vecye L. to be theirs absolutely, after the payment of the items in the
first clause of this will.
For the purpose of carrying into effect the provisions of this will I make constitute and
appoint as executors my wife Drusilla F. DOWNING my son Louis B. DOWNING and my daughter
Vecye L. DOWNING and I give them full power and authority to sell and convey all the
property disposed of by this instrument, being all the property I shall own at the time of
my death, and it is my desire and direction that they be not required to administor my
estate in the Courts or any Court, nor shall they be required to give bond as such
executors.
I am now Guardian and Curator of Kitty GLADNEY a person of unsound mind and should I die
while administering such trust I do not desire that this fact should make an
administration of my estate necessary as I have kept a true account of her estate as shown
by my Annual Statements in the Probate Court of this county, and my executors are
authorized to turn over the property and belongings to said Kitty GLADNEY which shall
remain in my hands ... to such person who may by proper authority be appointed to succeed
me. My Attorney O.H. AVERY having made settlements for me and is thoroughly cognizant of
the condition of said estate and will aid my executors in disbursing to Kitty GLADNEY or
such person as may be appointed to represent her, all property due her as my ward as shown
by the records of the Probate Court of Lincoln County, Missouri and my
account with her.
In witness whereof I have this 6th day of August 1909 signed my name and attached my seal
to this instrument for and as my last Will and Testament.
